Wife was in nursing home from Aug to Nov 2023 (passed in Nov 2023), husband claimed DTC on 2023 income tax return, did not claim nursing home expenses.
On 2024 tax return he wants to claim nursing home expenses, (you cannot claim both DTC and nursing home expenses). The receipt does not breakdown salaries etc.
The fact that DTC was claimed in 2023 and the nursing home expenses would be claimed in 2024 make a difference??
Any comments would be appreciated.

if wife passed in 2023, there's no claim for anything in 2024!
you would need to look at the amount of nursing home expenses as they cannot exceed $10,000 if the DTC is also claimed. He can claim a medical expense for the deceased after death. There is nothing stating that it must all be in the same tax year. I have copied the statement below from CRA
medical expenses paid on behalf of the deceased can be for any 24-month period that includes the date of death, as long as no one has claimed them on any other return or for any other year.
The husband would use medical expenses for the 12 month period from August 2023 to July 2024.
My concern is the fact that he claimed DTC in 2023 and none of the medical expenses, does it preclude that those specific nursing home expenses are not allowed because they pertain to 2023 during the period that a DTC claim was taken.
The medical expense receipt is not broken down to show how much was allocated to salaries etc.
If it were a portion could have been taken in 2023.
By waiting until the following year (2024) the entire expense could qualify as medical for the husband.
The qustion is "is this medical expense still available because the DTC claim was for the previous year"?
thank you. i don't believe there's a valid claim for 2023 nursing expense in 2024, since dtc was claimed in 2023. also, limit is raised to $20,000 in year of death?
