IRS Form 1099 tracks payments made to non-employees. The two most common forms are the 1099-NEC, Nonemployee Compensation, and the 1099-MISC, Miscellaneous Information. This guide will help you understand when and how to file these important tax forms.
| If you have 10 or more combined 1099s, W-2s, or other federal forms to file, you must file them electronically. To learn more, see IRS and Treasury issue final regulations on e-file for businesses. |
If you'd like to pay your contractors and file your 1099s directly through QuickBooks, consider adding Contractor Payments. If you have both employees and contractors, add QuickBooks Online Payroll.
Do I need to file a 1099-NEC?
US tax law requires you to file a Form 1099-NEC for anyone you paid $600 or more last year. This can be contractors, freelancers, vendors, or any other nonemployee. You’ll also need to file a Form 1099-NEC for any person you’ve withheld any federal income tax from under the backup withholding rules.
If you have previously reported any information on Box 7 of the 1099-MISC, which is the total amount of nonemployee compensation, this information is now reported on the 1099-NEC.
The IRS has rules to decide if a worker is an employee or a contractor. For assistance in classifying your workers, check with the IRS.
Do I need to file a 1099-MISC?
You're required by US tax law to file a 1099-MISC form for anyone that you paid $600 or more in the previous year. Unlike the 1099-NEC, the payments found on a 1099-MISC are geared toward vendors, attorneys, and other individuals who aren't a proper contractor.
If you have more questions about who needs to file, check with the IRS.
