How to pay a US citizen abroad for service (insurance leads)?

I want to work with a person in a foreign country who will provide me insurance leads they acquire from their call center in that same foreign country. This guy is a US person but working out of there, (1) is this legal and (2) what would I need to do to cover myself and the US person abroad? Thank you

Since you're a US citizen, you must provide the W9 form instead. The W8-BEN (for individuals) and W8-BEN-E (for entities) is equivalent form that applies to non-US citizen. 

In regards to the reported payments, we suggest contacting the IRS directly to make sure what payments should be included on the W9 form.

 

Here's how:

  1. Go to IRS.gov website.
  2. Click the Forms & Instructions tab.
  3. Select Form W-9.

I've searched and added articles from the IRS website for additional reference:

They'll be setting up a non residential employee (NRA) then verify it to the IRS, since the employee is a US Person but resides in Non US Country, which means this person does have SSN. If will they be exempt to tax or not.
