it is taxing the discount and it does not happen all the time only in certain instances. but we do not want discounts taxed either way

If the discount is taxable, the sale price is reduced by the discount amount with the sales tax.
While discounts that aren't taxable will not affect the sales tax, the sales tax is calculated based on the amount of taxable retail sales. It's up to the state sales tax department whether the discount is taxable.
To ensure that your discount will be nontaxable, you can tap the double arrow icon next to the discount field if you want to apply a discount to the total price and make sure that the sales tax comes first, then the discount.
