I have run the updates as suggested but it still says draft. Just wanting to watch for answers.
Also having this problem. Reported as a bug, but not sure if they check those. All updates complete and they claim that the 940 was part of the update.

The IRS may've already released a form, yet our Product Development team may need to take time to set up this function properly in the product.

Once a form you're waiting for is available in your books, you'll need to make sure to update the tax table to its latest release.

I have done this multiple times and it still is not working. Do you have any other suggestions? That form is approved because it is working in our other programs.

I was able to update my payroll this morning and the new 940 is available. I had to restart quickbooks to get it, but it is completed and submitted through e-file.

Allow me to chime in for a moment and share some information about the payroll tax forms in QuickBooks Desktop (QBDT).
Currently, we have an open investigation about the 940 form that shows the watermark "DRAFT FORM ONLY - DO NOT FILE. We have escalated this unexpected behavior to our Product Development team.
For now, we're unable to provide you with an estimated turnaround time when the investigation will be closed. I'd suggest giving us a call so and providing the investigation number INV-65838, so we can add you to the list of affected users. We'll let you know via email or by tagging you here as soon as the issue is resolved.

Not sure what was done today but I just did another download of the entire payroll update. Then I closed the program and opened it again and it is not in draft.
