QUICKBOOKS® PAY LINK TERMS OF SERVICE

Your use of the QuickBooks Pay Link service (“Payment Service”) provided by Intuit Inc., Intuit Payment Solutions, LLC, and/or its subsidiaries and affiliates (referred to as “Intuit”, “we”, “our” or “us”) is subject to these QuickBooks Pay Link Terms of Service, the terms of the Intuit Payments Merchant AgreementPrivacy StatementAcceptable Use Policy, and all other agreements in place or enacted between you and Intuit (collectively, the “Agreements”). These QuickBooks Pay Link Terms of Service shall prevail in the event of any conflict or inconsistency with the remainder of the Agreements with respect to the Payment Service.

1. Service Description. The Pay Link is intended solely for business use for Intuit Payments Merchants to request, collect, and receive payments from others. The Payment Service enables you to create a personalized QuickBooks Pay Link URL, (“Pay Link”), and which allows you to create a personalized QuickBooks Pay page (“Pay Page”) that will allow others to find, recognize and transact with you. Your Pay Page will display your Pay Link, business name, and a profile picture or logo associated with your QuickBooks account (“Pay Details”). Your Pay Details will be displayed to anyone visiting your Pay Page so that they can confirm that they are sending a payment to the intended merchant.

2. Sharing Information Through the Payment Service. When you sign up to the Payment Service, you authorize Intuit to publicly display your Pay Details and Pay Page and understand that they will be shared with anyone using the Pay Link. Please visit the settings in your QuickBooks payment account online at any time to turn on or off your Pay Link. If you turn off your Pay Link, your Pay Page and Pay Details will no longer be public for others to find, and you cannot use your Pay Link to receive payments.

3. Permitted Transactions. Pay Links are an optional feature associated with Intuit Payments Merchant accounts, and as such, are solely for receiving payments from customers for goods and services. You may not use the Pay Link for personal transactions, charitable contributions, or for the prohibited activities defined in the Acceptable Use Policy.

4. Pay Link User Guidelines. In addition to complying with the Agreements, the following guidelines for using the Payment Service were created:

(a) Pay Links may be issued only to underwritten merchants registered with Intuit for payment processing services. As such, you may not provide third parties with your QuickBooks password or other credentials to manage your Pay Link. Similarly, you may not use the Pay Link of any third party.

(b) You may not request a Pay Link URL, provide details or content to populate your Pay Page, or transact in a manner, which is, or includes material that:

(i) is fraudulent or illegal, or intended to commit, perpetrate, or promote fraud or illegal actions;

(ii) is obscene or contains adult content;

(iii) is abusive, defamatory, offensive, or threatening;

(iv) includes proprietary or personal data of third parties, including intellectual property such as trademarks or brand names;

(v) misrepresents your affiliation with any third party, or is otherwise misleading, deceptive, or incorrect; or

(vi) violates the Agreements, as determined by Intuit in its sole discretion.

5. Termination. If you violate any terms of this Agreement, your right to use the Payment Service may be immediately terminated. Intuit may also cease offering the Payment Service or your individual Pay Link for any reason.
